Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Services provided by OPTICOMM AI S.R.L. ("OptiComm"). It is incorporated into and forms part of our Terms and Conditions. Capitalised terms not defined here have the meaning given in the Terms. This AUP applies to you, your Authorised Users, and anyone using the Services through your Account.

We may update this AUP from time to time; the current version always applies.

1. Purpose

This AUP protects our customers, our Services, third parties, and the public from harmful, unlawful, or abusive use. It sets out what you may not do when using the Services, including the AI need-prediction platform, the Sales Intelligence dashboard, and the AI voice agents.

2. Prohibited activities

You must not use the Services to, and must not permit any third party to:

a) Violate laws or rights. Engage in any unlawful activity, or infringe the intellectual property, privacy, publicity, or other rights of any person.

b) Upload harmful or illegal content. Store, transmit, or distribute content that is defamatory, obscene, harassing, hateful, or that depicts or promotes child sexual abuse material, violence, or terrorism.

c) Compromise security. Attempt to gain unauthorised access to any system, account, network, or data; probe, scan, or test the vulnerability of any system without authorisation; or breach or circumvent authentication or security measures.

d) Distribute malware. Introduce viruses, worms, trojans, ransomware, or any other malicious or harmful code.

e) Disrupt the Services. Interfere with or disrupt the integrity or performance of the Services, for example through denial-of-service attacks, flooding, or imposing an unreasonable load on infrastructure.

f) Abuse messaging and calling. Send spam, unsolicited bulk communications, or phishing; or use the AI voice agents for unlawful telemarketing, robocalling, or other communications without a valid legal basis and any required prior consent of the recipient, in breach of applicable rules on electronic communications and direct marketing.

g) Misuse data. Harvest or scrape data without authorisation, or process personal data in violation of applicable law or without a valid legal basis.

h) Evade limits. Circumvent usage limits, rate limits, quotas, or access controls, or use the Services in a way designed to avoid incurring fees.

i) Reverse engineer or compete. Reverse engineer the Services (except as permitted by law), or use the Services or their Outputs to build, train, or benchmark a competing product or model.

j) Misrepresent identity. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

k) Run unauthorised workloads that are not part of the intended use of the Services (e.g. cryptocurrency mining).

3. Use of AI features and voice agents

When using the AI prediction features and AI voice agents, you must not:

  • use them to generate unlawful, deceptive, or harmful content, or to manipulate, defraud, or mislead individuals;
  • deploy the voice agents to contact individuals without a lawful basis, or where the recipient has objected or is on a do-not-call/suppression list;
  • suppress or remove the AI disclosure that informs recipients they are interacting with an AI system, as required by the EU AI Act;
  • record or transcribe calls without the notices and/or consents required by applicable law;
  • make fully automated decisions with legal or similarly significant effects on individuals without appropriate human oversight and a lawful basis; or
  • attempt to infer special categories of personal data unlawfully.

You are responsible for reviewing AI Outputs before relying on them and for the lawfulness of the contact data and instructions you provide.

4. Customer responsibilities

You are responsible for: (a) all activity under your Account; (b) the lawfulness of Customer Data, contact lists, and your right to process them; (c) maintaining the confidentiality of credentials; (d) configuring the Services securely; and (e) ensuring your Authorised Users comply with this AUP.

5. Monitoring and cooperation

We do not routinely monitor the content you process. However, we may investigate suspected violations, and you agree to cooperate with reasonable requests to identify the source of a problem. We may report unlawful activity to the relevant authorities where required.

6. Reporting abuse

To report a suspected violation of this AUP, a security vulnerability, or abusive content, contact security@opticomm.ai. We aim to acknowledge reports promptly.

7. Enforcement

If we determine that you have violated this AUP, we may, depending on severity: (a) issue a warning and request remediation; (b) remove or disable offending content; (c) suspend the affected Service or Account; or (d) terminate in accordance with the Terms. Where a violation poses an immediate risk to security, legal compliance, or third parties, we may act without prior notice. We will use reasonable efforts to give notice where practicable.

8. Changes

We may modify this AUP to address new risks or legal requirements. Material changes will be notified in accordance with the Terms.
